1. Construction works and activities - list

It is necessary to decide what kind of work can be considered construction, because this affects what documents you need.

Construction activities (construction) - activities for the construction, reconstruction, repair, restoration, improvement of the facility, demolition, conservation of an unfinished facility, including the implementation of organizational and technical measures, including the provision of engineering services in construction, preparation of permits and design documentation, implementation construction and installation, commissioning works.

This definition is normatively enshrined in legislation. But the ideal situation would be to have at hand a table in which a list of construction works would be given.

Fortunately, the list of works (and services) related to construction activities was approved by the Resolution of the Ministry of Architecture and Construction of the Republic of Belarus dated May 10, 2011 No. 17.

As a general rule, for the implementation of construction, the following documents may be needed:

  • qualification certificates for employees;
  • occupational safety management system (briefly - OSH);
  • assessment of the production control system (in short - SPK) - is drawn up by a certificate of technical competence of the SPK;

Certification of work conformity: do you need it? Algorithm of actions

Mandatory certification of works in construction is provided for by the Technical Regulations of the Republic of Belarus “Buildings and structures, construction materials and products.     3) restoration of individual sections of waterproofing walls of basements;

    4) punching (sealing) of holes, nests, grooves;

    5) device (sealing) of ventilation ducts, branch pipes;

    6) replacement of individual sections of the blind area along the perimeter of the building, structure;

    7) sealing of entrances to basements and technical undergrounds;

    8) the device of beacons on the walls to monitor deformations.

    A.2 Main types of work for walls:

    1) sealing cracks, joining joints, restoring the facing of individual sections with an area of ​​up to 2 m2;

    2) sealing the joints of elements of prefabricated buildings and sealing potholes and cracks on the surface of blocks and panels;

    3) punching (sealing) of holes, nests, grooves;

    4) change of individual crowns, frame elements, strengthening, insulation, caulking grooves, changing sections of wooden wall cladding;

    5) laying of openings in the walls;

    6) setting on solution of separate fallen stones;

    7) insulation of freezing wall sections (elimination of dampness and airflow) in separate rooms (along the riser or in one level of the apartment) with the development of project documentation and its approval with local executive and regulatory bodies in the field of architectural activities;

    8) cleaning and repair of ventilation ducts and exhaust devices.

    A.3 The main types of work for floors:

    1) temporary fastening of floors;

    2) partial replacement or strengthening of individual elements of wooden floors (sections of interbeam fillings, plank filing, individual beams); restoration of backfill and lubrication; antiseptic and fire protection of wood;

    3) sealing of seams at the joints of precast concrete floors;

    4) sealing potholes and cracks in reinforced concrete structures;

    5) insulation of the upper flanges of steel beams and their painting;

    6) insulation in certain areas of the attic floors.

    A.4 Main types of work for roofs:

    1) replacement of individual beds, mauerlats and battens;

    2) atiseptic and fire protection of wooden structures;

    3) all types of work to eliminate minor roof malfunctions;

    4) strengthening and partial replacement of drainpipes and coatings of small architectural elements along the facade;

    5) repair (partial replacement, no more than 40%) of individual sections of roofs or roof coatings, including nodes of abutment to vertical surfaces;

    6) partial replacement of parapet slabs, fire escapes, ladders, sleeves, roof fences, grounding devices, anchors, antennas for radio and television antennas;

    7) installation or restoration of the protective layer of roll and mastic roofs;

    8) restoration of waterproofing of individual elements of the roof;

    9) replacement or repair of roof exits, skylights and special hatches.

    A.5 Main types of work for window and door fillings, translucent structures:

    1) replacement of doorway fillings; restoration of individual elements of window, stained-glass and display cases; partial replacement (no more than 40%) in the building of window fillings

    and stained glass openings with their wear of 60% or more;

    2) installation of devices for self-closing doors, springs, stops;

    3) replacement of window and door fittings;

    4) replacement of broken glass, glass blocks;

    5) inset of vents and opening transoms;

    6) installation of fire doors and hatches.

    A.6 Main types of work for partitions:

    1) strengthening, strengthening, replacement of individual sections of wooden partitions;

    2) sealing cracks in slab partitions, re-laying of individual sections;

    3) improving the soundproofing properties of partitions (sealing joints with adjacent structures and other works).

    A.7 Main types of work for stairs, balconies, porches, umbrellas, canopies over entrances

    3) sealing potholes, cracks in cement, concrete, asphalt floors and sub-floors;

    4) rallying plank floors;

    5) elimination of subsidence of the ground floor of the first floor.

    A.9 Main types of work for furnaces:

    1) all types of work to eliminate malfunctions of stoves and chimneys, relocating them in separate apartments;

    2) re-laying of individual sections of branch pipes, hogs.

    A.10 Main types of work for interior decoration:

    1) restoration of plaster and cladding of walls and ceilings, including suspended in separate places;

    2) alignment of walls and ceilings using sheet and molded materials;

    3) restoration and strengthening of molded decorative details;

    4) all types of painting work;

    5) bringing the finishing of walls and ceilings on the escape routes in accordance with the requirements of the TNLA.

    A.11 Main types of work for exterior decoration:

    1) sandblasting, washing, painting of façade areas;

    2) restoration of areas of plaster and cladding;

    3) strengthening or removing from the facade of architectural details threatening to fall, facing tiles, individual bricks; restoration of stucco details;

    4) exterior painting of windows, doors, balconies, parapet grids, drainpipes, pergolas, plinths;

    5) restoration of house signs, notices;

    6) renovation of facades, improvement of the architectural expressiveness of facades.

    A.12 Main types of work for heating:

    1) change of individual sections of pipelines, sections of heating devices, individual non-separable heating devices (plate, etc.), shut-off and control valves, mud collectors, elevator units;

    2) installation (if necessary) of air valves;

    3) insulation of pipes, devices, expansion tanks;

    4) re-lining of boilers, blast channels, chimney hogs (in the boiler room);

    5) change of individual sections of cast iron boilers, fittings, instrumentation, grates;

    6) replacement of electric motors or low-power pumps;

    7) restoration of partially destroyed thermal insulation;

    8) hydraulic testing and flushing of the system;

    9) flushing of individual heating devices of the in-house riser;

    10) adjustment and commissioning of heating systems;

    11) installation and replacement of metering devices and regulation of heat energy in the local implementation of these works.

    A.13 Main types of work for ventilation:

    1) change of individual sections and elimination of leaks in ventilation boxes, mines, chambers, air ducts;

    2) repair and replacement of fans, air valves and other equipment;

    3) repair, replacement, installation of deflectors, pipe heads;

    4) repair and adjustment of automatic fire extinguishing, smoke removal, alarm systems.

    A.14 Main types of work for water supply, sewerage, hot water supply (in-house systems):

    1) sealing joints, eliminating leaks, warming, strengthening pipelines, replacing individual sections of pipelines, fittings, siphons, ladders, revisions; restoration of the destroyed thermal insulation of pipelines, hydraulic testing of the system (risers), elimination of blockages, cleaning of the yard sewage system, drainage;

    2) replacement of individual worn-out water taps, shower mixers, valves, sanitary fixtures and fittings (washbasins, toilets, etc.) in public buildings;

    3) insulation and replacement of fittings for water tanks in attics;

    4) replacement of individual sections and lengthening of outdoor water outlets for watering courtyards and streets;

    5) replacement of fire hydrants;

    6) repair and replacement of pumps and low-power electric motors;

    7) replacement of individual units or water heaters for baths, strengthening and replacement of smoke exhaust pipes; cleaning water heaters and coils from scale and deposits;

    8) cleaning the sewage system;

    9) anti-corrosion coating, marking;

    10) repair or replacement of control valves, instrumentation;

    11) flushing of water supply and sewerage systems;

    12) installation and replacement of devices for group and apartment metering of cold and hot water supply when performing these works locally.

    A.15 Main types of work for electrical and low-current devices:

    1) replacement of faulty sections of the electrical network of the building;

    2) replacement of failed switches, plugs, sockets and other devices (except for residential premises);

    3) replacement of lamps, as well as protective lights and festive illuminations;

    4) replacement of fuses, automatic switches, batch switches of input distribution devices, boards;

    5) replacement of electric motors and individual units of electrical installations of technical devices;

    6) ensuring electrical safety of electric stoves;

    7) elimination of failures of elevators and systems of dispatch control over their work;

    8) replacement or installation of automatic control systems for the operation of central heating, in-house communication and signaling networks, instrumentation;

    9) connection of technical devices of buildings to the united dispatching service, regional dispatching service;

    10) repair of devices for electrical protection of metal pipes of in-house central heating and water supply systems against corrosion;

    11) repair of radio, television and telephony networks;

    12) restoration of ground circuits;

    13) replacement of failed sensors, wiring and fire and burglar alarm equipment.

    A.16 Main types of work for external improvement:

    1) repair of sections of sidewalks, driveways, paths and platforms;

    2) restoration of damaged green spaces, lawns;

    3) repair, strengthening, replacement of certain sections of fences and equipment for children's playgrounds, sports and utility grounds, courtyard latrines, garbage cans, platforms and sheds for waste containers;

    4) arrangement and repair of benches installed in the adjacent territories;

    5) the device or replacement of the blind area, the device of ramps on the porches of the entrances to buildings.

    A.17 Other work:

    1) strengthening and installation of metal gratings enclosing the windows of the premises;

    2) restoration and installation of new passages in the attic through central heating pipes, ventilation ducts;

    3) replacement or strengthening of gates of garbage chutes and garbage hatches, installation of devices for cleaning barrels;

    4) adjustment of all types of indoor equipment.

2) construction work performed at facilities of the fifth class of complexity;

    5.5.1. Single-family residential buildings up to 7 m high.

    5.5.4. Complete factory-made pavilions, kiosks for commercial and auxiliary purposes with an area of ​​up to 50 sq.m.

    5.5.5. Mobile (inventory) buildings or structures.

    5.5.6. Garden houses, outbuildings on personal, garden and summer cottages.

    5.5.7. Temporary power and communication lines, including power transmission, communication and outdoor lighting towers.

    5.5.8. Detached buildings and structures for auxiliary and auxiliary purposes of agricultural agro-industrial complexes.

    5.5.9. Structures for outdoor advertising.

    5.5.10. Buildings of one-storey aboveground box-type parking garages without a basement, with exits directly outside, with a capacity of up to 100 cars.

    5.5.11. Parking facilities for up to 100 cars.

    5.5.12. Warehouse buildings and structures without sorting and packaging processes up to 200 sq. M..

    5.5.13. Buildings and structures of objects of agroecotourism of the 1st and 2nd categories according to TCP 45-3.02-191 "Buildings and premises of recreation and tourism organizations. Design rules".

    5.5.14. Temporary and seasonal roads.

    5.5.15. Buildings and structures that, according to their technical characteristics, cannot be attributed to the class of complexity K-4.

3) services in construction provided by business entities, including individual entrepreneurs, by individual orders of individuals.

3. Certificate of conformity for construction work

According to subparagraph 1.11 of clause 1 of the Decree of the President of the Republic of Belarus No. 26 dated 14.01.2014. "On measures to improve construction activities" certain types of architectural, urban planning, construction activities (their components) according to the List approved by the Council of Ministers of the Republic of Belarus, as well as work on the inspection of buildings and structures are carried out by legal entities (individual entrepreneurs) in the presence of certificates of conformity issued in accordance with the Regulations on the certification of legal entities and individual entrepreneurs engaged in certain types of architectural, urban planning, construction activities (their components), the performance of work on the inspection of buildings and structures (approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 21.03.2014 No. 252).

The implementation of types of architectural, urban planning, construction activities (their components), performance of work on the inspection of buildings and structures without a certificate of conformity, when its presence is mandatory, is prohibited.

    2) partial replacement or strengthening of individual elements of wooden floors (sections of interbeam fillings, plank filing, individual beams); restoration of backfill and lubrication; antiseptic and fire protection of wood;

    3) sealing of seams at the joints of precast concrete floors;

    4) sealing potholes and cracks in reinforced concrete structures;

    5) insulation of the upper flanges of steel beams and their painting;

    6) insulation in certain areas of the attic floors.

    A.4 Main types of work for roofs:

    1) replacement of individual beds, mauerlats and battens;

    2) atiseptic and fire protection of wooden structures;

    3) all types of work to eliminate minor roof malfunctions;

    4) strengthening and partial replacement of drainpipes and coatings of small architectural elements along the facade;

    5) repair (partial replacement, no more than 40%) of individual sections of roofs or roof coatings, including nodes of abutment to vertical surfaces;

    6) partial replacement of parapet slabs, fire escapes, ladders, sleeves, roof fences, grounding devices, anchors, antennas for radio and television antennas;

    7) installation or restoration of the protective layer of roll and mastic roofs;

    A.5 Main types of work for window and door fillings, translucent structures:

    1) replacement of doorway fillings; restoration of individual elements of window, stained-glass and display cases; partial replacement (no more than 40%) in the building of window fillings

    and stained glass openings with their wear of 60% or more;

    2) installation of devices for self-closing doors, springs, stops;

    3) replacement of window and door fittings;

    4) replacement of broken glass, glass blocks;

    5) inset of vents and opening transoms;

    6) installation of fire doors and hatches.

    A.6 Main types of work for partitions:

    1) strengthening, strengthening, replacement of individual sections of wooden partitions;

    A.8 Main types of work for floors:

    1) replacement or repair of floor coverings in individual rooms without changing the design;

    2) replacement (device) of waterproofing floors in individual sanitary facilities with a complete change of the coating;

    3) sealing potholes, cracks in cement, concrete, asphalt floors and sub-floors;

    4) rallying plank floors;

    5) elimination of subsidence of the ground floor of the first floor.

    A.9 Main types of work for furnaces:

    1) all types of work to eliminate malfunctions of stoves and chimneys, relocating them in separate apartments;

    2) re-laying of individual sections of branch pipes, hogs.

    A.10 Main types of work for interior decoration:

    1) restoration of plaster and cladding of walls and ceilings, including suspended in separate places;

    2) alignment of walls and ceilings using sheet and molded materials;

    3) restoration and strengthening of molded decorative details;

    4) all types of painting work;

    5) bringing the finishing of walls and ceilings on the escape routes in accordance with the requirements of the TNLA.

    A.11 Main types of work for exterior decoration:

    1) sandblasting, washing, painting of façade areas;

    2) restoration of areas of plaster and cladding;

    3) strengthening or removing from the facade of architectural details threatening to fall, facing tiles, individual bricks; restoration of stucco details;

    4) exterior painting of windows, doors, balconies, parapet grids, drainpipes, pergolas, plinths;

    5) restoration of house signs, notices;

    6) renovation of facades, improvement of the architectural expressiveness of facades.

    A.12 Main types of work for heating:

    1) change of individual sections of pipelines, sections of heating devices, individual non-separable heating devices (plate, etc.), shut-off and control valves, mud collectors, elevator units;

    2) installation (if necessary) of air valves;

    3) insulation of pipes, devices, expansion tanks;

    4) re-lining of boilers, blast channels, chimney hogs (in the boiler room);

    5) change of individual sections of cast iron boilers, fittings, instrumentation, grates;

    6) replacement of electric motors or low-power pumps;

    7) restoration of partially destroyed thermal insulation;

    8) hydraulic testing and flushing of the system;

    9) flushing of individual heating devices of the in-house riser;

    10) adjustment and commissioning of heating systems;

    11) installation and replacement of metering devices and regulation of heat energy in the local implementation of these works.

    A.13 Main types of work for ventilation:

    1) change of individual sections and elimination of leaks in ventilation boxes, mines, chambers, air ducts;

    2) repair and replacement of fans, air valves and other equipment;

    3) repair, replacement, installation of deflectors, pipe heads;

    4) repair and adjustment of automatic fire extinguishing, smoke removal, alarm systems.

    A.14 Main types of work for water supply, sewerage, hot water supply (in-house systems):

    1) sealing joints, eliminating leaks, warming, strengthening pipelines, replacing individual sections of pipelines, fittings, siphons, ladders, revisions; restoration of the destroyed thermal insulation of pipelines, hydraulic testing of the system (risers), elimination of blockages, cleaning of the yard sewage system, drainage;

    2) replacement of individual worn-out water taps, shower mixers, valves, sanitary fixtures and fittings (washbasins, toilets, etc.) in public buildings;

    3) insulation and replacement of fittings for water tanks in attics;

    4) replacement of individual sections and lengthening of outdoor water outlets for watering courtyards and streets;

    5) replacement of fire hydrants;

    6) repair and replacement of pumps and low-power electric motors;

    7) replacement of individual units or water heaters for baths, strengthening and replacement of smoke exhaust pipes; cleaning water heaters and coils from scale and deposits;

    8) cleaning the sewage system;

    9) anti-corrosion coating, marking;

    10) repair or replacement of control valves, instrumentation;

    11) flushing of water supply and sewerage systems;

    12) installation and replacement of devices for group and apartment metering of cold and hot water supply when performing these works locally.

    A.15 Main types of work for electrical and low-current devices:

    1) replacement of faulty sections of the electrical network of the building;

    2) replacement of failed switches, plugs, sockets and other devices (except for residential premises);

    3) replacement of lamps, as well as protective lights and festive illuminations;

    4) replacement of fuses, automatic switches, batch switches of input distribution devices, boards;

    5) replacement of electric motors and individual units of electrical installations of technical devices;

    6) ensuring electrical safety of electric stoves;

    7) elimination of failures of elevators and systems of dispatch control over their work;

    8) replacement or installation of automatic control systems for the operation of central heating, in-house communication and signaling networks, instrumentation;

    9) connection of technical devices of buildings to the united dispatching service, regional dispatching service;

    10) repair of devices for electrical protection of metal pipes of in-house central heating and water supply systems against corrosion;

    A.16 Main types of work for external improvement:

    1) repair of sections of sidewalks, driveways, paths and platforms;

    2) restoration of damaged green spaces, lawns;

    3) repair, strengthening, replacement of certain sections of fences and equipment for children's playgrounds, sports and utility grounds, courtyard latrines, garbage cans, platforms and sheds for waste containers;

    4) arrangement and repair of benches installed in the adjacent territories;

    5) the device or replacement of the blind area, the device of ramps on the porches of the entrances to buildings.

    A.17 Other work:

    1) strengthening and installation of metal gratings enclosing the windows of the premises;

    3) replacement or strengthening of gates of garbage chutes and garbage hatches, installation of devices for cleaning barrels;

    4) adjustment of all types of equipment inside the house.

4. Certified specialists in the state

The availability of certified specialists is necessary for the certification of construction works and the assessment of the production control system.

Experts pass the exam in the manner prescribed by the Regulation on the certification of managers, specialists of organizations and individual entrepreneurs carrying out activities in the field of architectural, urban planning, construction activities, performance of work on the inspection of buildings and structures (approved by the Resolution of the Council of Ministers of the Republic of Belarus dated March 21.03.2014, 252 No. ).

Based on the results of certification, specialists are issued qualification certificates.

The list of managers, specialists of organizations and individual entrepreneurs who carry out activities in the field of architectural, urban planning, construction activities, the performance of work on the inspection of buildings and structures, the criteria for their admission to certification in its specializations, are approved by the Decree of the Ministry of Architecture and Construction of the Republic of Belarus dated 26.03.2014 No. 15.

5. Production control system

It is necessary for certification of works, as well as for obtaining a certificate of conformity by a legal entity or individual entrepreneur.

The SPK is being assessed in accordance with TCP 45-1.01-221-2010 (02250) “Construction. Assessment of the production control system. Basic Provisions and Procedure ".

6. Occupational safety management system (OSHMS)

According to article 17 of the Law of the Republic of Belarus of 23.07.2008 N 356-З "On labor protection" and paragraph 8 of article 226 of the Labor Code of the Republic of Belarus, the employer must develop, implement and maintain the functioning of the labor protection management system, which provides identification of hazards, assessment of occupational risks, determination of professional risk management measures and analysis of their effectiveness.

An OSHMS is being developed and implemented in accordance with STB 18001-2009 “Occupational safety management systems. Requirements ".

Construction contract for legal entities

We present you a sample for filling and downloading building contract, with attachments to it: construction schedule, payment schedule, material supply schedule.

Under a construction contract (hereinafter referred to as the contract), the contractor undertakes to construct a specific object at the request of the customer within the time period established by the contract, or to perform construction and other special installation work and hand them over to the customer, and the customer undertakes to create the necessary conditions for the contractor to perform the work, accept the results of these works, and pay the stipulated price.

Our contract provides conditions that are most often agreed between the parties in practice. This applies to the terms of payment, the procedure for terminating the contract and the liability of the parties.

The contract is concluded subject to the availability of the customer:

  • permits for the design, construction, reconstruction, restoration, overhaul of the facility issued by the local executive and administrative body in accordance with the established procedure (except for facilities during the construction of which, in accordance with the legislation, obtaining permits is not required or the contract provides for the construction of a turnkey facility) ;
  • extracts from the registration book on rights, restrictions (encumbrances) of rights to a land plot on which construction will be carried out, issued no earlier than 30 days before the date of the conclusion of the contract;
  • project documentation for the construction, reconstruction, restoration, overhaul, improvement of the facility, which has passed the state examination in the cases and in the manner prescribed by law, and approved in the prescribed manner (hereinafter referred to as project documentation), if the obligation to provide project documentation is not imposed by the contract on the contractor;
  • a protocol on the results of the contract bidding and the selection of their winner, if the contract bidding is mandatory;
  • documents confirming the right to carry out architectural, urban planning and construction activities, in cases stipulated by law.

And subject to the availability of the contractor:

  1. documents confirming the right to carry out architectural, urban planning and construction activities, in cases stipulated by law;
  2. for the construction of buildings and structures of I and II levels of responsibility, as well as for carrying out major repairs, reconstruction, restoration, improvement at these facilities, the right to carry out architectural, urban planning and construction activities is confirmed by the work performer (contractor, subcontractor) certificates of conformity of works in construction and documents confirming the availability of a production control system;
  3. in the state of certified specialists.
  4. reservation on a special account of funds in the amount of 1,5% of the cost of construction, special, installation work performed at the facility;
  5. bank guarantee;
  6. liability insurance under a construction contract for non-fulfillment or improper fulfillment of such obligations.

There is a separate contract for maintenance or finishing works:

The contract is suitable for repair and finishing works, the customer can be legal entities, individual entrepreneurs and individuals. Contractors can only be individual entrepreneurs and legal entities.
